Abstract
The law establishes the legal framework for the management, conservation, and sustainable use of fish populations and aquatic ecosystems in Tyrol, Austria. The law applies to all fishable waters, angling ponds, and fish or crayfish farms in the region. Its primary goals are to maintain or restore healthy, species-rich populations of aquatic animals appropriate to each body of water, safeguard their habitats, and ensure the sustainable economic use of fisheries resources. The Act defines key terms such as fishery rights, fishable waters, and the responsibilities of fishery right holders. It distinguishes between private and communal fishing districts, sets out the process for designating and managing these areas, and requires the registration of fishery rights in the land register. The law also details how fishing rights can be acquired, transferred, or divided, and mandates the maintenance of official registers and maps of fishing districts.
The Act further regulates the exercise of fishing, including licensing requirements, the issuance of Tyrolean fishing cards, and mandatory examinations for anglers and professional fishers. It sets out obligations for fishery managers regarding stock protection, restocking, and sustainable harvest, and includes provisions for the protection of aquatic animals from predators and environmental threats. The law covers the operation of fish farms, angling ponds, and net enclosures, and establishes rules for the protection and supervision of fisheries, including the appointment and powers of fishery protection officers. The Tyrolean Fisheries Association is recognized as a key stakeholder, with defined roles in management and oversight. Finally, the Act provides for cooperation with public authorities, data protection, penalties for violations, and transitional arrangements to ensure effective implementation and compliance with both regional and EU fisheries regulations. The law consists of 66 Articles divided into 8 Chapters.
