Abstract
This Act regulates public access to environmental information in Vienna, implementing EU Directive 2003/4/EC. It grants individuals and organizations the right to access environmental data held by public authorities or entities performing environmental public services, without the need to prove a legal interest. The law defines environmental information broadly, including data on air, water, soil, biodiversity, emissions, waste, energy, and human health impacts. It requires authorities to process requests promptly, maintain transparency, and provide information in accessible formats, preferably through electronic communication, while also allowing for active public dissemination via the Vienna Environmental Information System. The Act sets conditions for denial or restriction of access, such as protection of personal data, trade secrets, public security, intellectual property, or ongoing proceedings, requiring a careful balance with the public interest. The text consists of 15 articles.
