Abstract
The Conservation, Forests and Lands (Infringement Notice) Regulations 2023 (S.R. No. 50/2023) prescribe specific offences across a wide array of environmental and land management legislation in Victoria, and assign corresponding infringement penalties expressed in penalty units. The instrument comprises fourteen schedules, each aligned with a distinct legislative domain, including but not limited to the Catchment and Land Protection Act 1994, Forests Act 1958, Crown Land (Reserves) Act 1978, National Parks Act 1975, Wildlife Act 1975, and Flora and Fauna Guarantee Act 1988. Each schedule enumerates prescribed infringement offences by reference to statutory sections or regulatory clauses, and stipulates the applicable penalty units. These units are subject to annual indexation under the Monetary Units Act 2004, with the value for the financial year commencing 1 July 2022 set at $184.92 per unit. The offences encompass a broad spectrum of conduct, including unauthorised activities in protected areas, breaches of licence conditions, and contraventions of conservation regulations.
