Abstract
Under the Act dividing fence means a fence that separates the lands of different owners whether the fence is on the common boundary of adjoining lands or on a line other than the common boundary. Part II regulates construction of dividing fence, this includes liability of owners of adjoining lands to fence, the requirement to give notice to fence, and proceedings in default of agreement, proceedings on failure to carry out agreement or order, proceedings for defining boundary line by surveyor, etc. Part III concerns duties and liabilities related to repair of dividing fences.
