Abstract
The Fisheries Management Regulation concerns several areas of fisheries management and conservation; Part 2 establishes limits and prohibitions in size for fish and bags, protected fish and protected waters. PArt 3 regulates fishing gears (lawful commercial and recreational nets, traps, use of lines, and other restrictions concerning the fishing of rock lobster, worm, pipies, etc). Part 4 sets out the rights of priority between commercial fishers and recreational fishers on recognised fishing grounds and the rights of priority between commercial fishers in inland waters. Rights of priority between commercial fishers in share management fisheries are set out in the share management plans for the fisheries. Rights of priority between commercial fishers on recognised fishing grounds are set out in the Supporting Plan. Part 5 regulates recreational fishing fees. Part 6 general fisheries management provisions include penalties due to interference with fishing activities, use of explosives, electrical devices and other dangerous substances, tagging and labelling. Part 7 concerns share management fisheries; for the purposes of section 49 (2) of the Act a foreign person or a foreign-owned body is prohibited from holding shares in a share management fishery. Part 8 regulates licences for commercial fishing and boats, this include conditions, refusal and renewal and who may hold licences. Part 9 concern restricted fisheries; sea urchin and turban shell restricted fishery, southern fish trawl restricted fishery, inland restricted fisheries. The Part also identify endorsement opportunities for commercial fishing licence holders that authorises the holder to fish or take fish under specific conditions. Part 10 contains fishing business transfer rules. Part 11 regulates administration of commercial fishing businesses. Part 12 is regulates the Charter fishing Management
Part 13 contains provisions on protection of aquatic habitats. It regulates application for permit under Part 7 of Act; an application for a permit under Part 7 of the Act is to be in a form approved by the Secretary and is to be accompanied by (a) the fee specified in Schedule 6, and (b) an assessment fee. Part 14 provides for threatened species; criteria for listing of species and population, and ecological communities. Part 14 establishes for the purposes of section 229 of the Act, the following advisory councils: (a) Ministerial Fisheries Advisory Council, (b) Recreational Fishing NSW Advisory Council, (c) Aboriginal Fishing Advisory Council, (d) Commercial Fishing NSW Advisory Council.
