Abstract
The Forests (Licences and Permits) Regulations 2019 (S.R. No. 130/2019), prescribe the legal framework governing activities within State forests in Victoria, including offences, licensing procedures, and branding of forest produce. The regulations define prohibited conduct within State forests unless authorised, such as damaging infrastructure, interfering with research equipment, or selling goods. Entry of cattle into reserved forests is restricted and subject to licensing or temporary permits issued by the Secretary, with penalties applicable for non-compliance. Licences and permits under section 52 of the Forests Act 1958 must be applied for in a prescribed form and are subject to detailed conditions. These include obligations to repair environmental or structural damage, prevent pollution, pay fees, and obtain written authority for certain activities such as construction or use of chemicals. Specific conditions apply to licences for cutting, digging, or removing forest produce, including compliance with branding requirements and the Code of Practice for Timber Production 2014. Grazing and agistment licences impose further requirements, including notification obligations, restrictions on bulls, and cost responsibilities for cattle management. Branding regulations specify the use of crown and broad arrow brands by authorised officers and require licensees to register distinctive brands when directed.
