Abstract
An Act to provide for the irrigation of land in private irrigation districts and existing government districts or district to be established or extended under this Act. Section 6 provides for establishment or extension of irrigation districts. Section 9 defines existing private irrigation areas. Section 10 provides for the establishment of private irrigation districts. A government irrigation district or part of a government irrigation district may be converted to a private irrigation district pursuant to Part 4. Division 2 of Part III provides for the merger of two or more private districts. The owners for the time being of the irrigated properties comprising a private irrigation district constitute a trust having as its name the name of the irrigation district followed by "Trust Incorporated" (Division 2 of Part III). Part IV contains rules relative to the conversion of Government districts to private districts. Subject to subsection (2), the owner or occupier of an irrigated property is entitled to use the quantity of water allocated in respect of that property for the purposes for which it was allocated (sect. 53 on the right to water). Section 54 outlines restrictions on and obligations of landowners in respect of irrigation. The remaining provisions of the Act deal with charges, appeals, finance, and miscellaneous matters.
