Abstract
This Act, consisting of 251 sections divided into 22 Parts and completed by two Schedules, implements the International Convention for the Prevention of Pollution from Ships 1973 (MARPOL) and provides for the protection of the marine and coastal environment from pollution by oil and other pollutants.
The Act concerns in particular prevention of pollution by oil (Part 3), prevention of pollution by noxious liquid substances (Part 4), prevention of pollution by packaged harmful substances (Part 5), prevention of pollution by sewage (Part 6), prevention of pollution by garbage (Part 7) and prevention of pollution during transfer operations (Part 8).
The Act further provides for: reporting of pollution incidents; shipboard oil pollution emergency plans and other plans; record keeping; regulations and requirements relating to the construction of ships; obligation o ships to be insured against damage by discharge of oil; reception facilities for collecting waste; actions taken by the Minister to prevent or clean-up pollution; marine pollution clean-up notices, marine pollution prevention notices and marine pollution prohibition notices; recovery of costs, expenses and damages relating to prohibited discharges; detention of ships that have discharged marine pollutants and taking of securities; appointment and powers of inspectors and authorized persons; proceedings for enforcement; etc.
