Abstract
The present Regulations provide for the discipline of marine pollution. Part 2 regulates oil pollution; under section 97 of the MArine Pollution Act 2012 a shipboard oil pollution emergency plan must comply with the requirements of the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 of the Commonwealth, section 11A(4). Oil record books for oil tankers as identified under section 12 (1) (a) and (b) of the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 must comply with form of MARPOL, Annex I, Appendix III, Parts I and II. Part 3 concerns noxious liquid substances; the following provisions of MARPOL, Annex II have effect for a vessel to which the Act, Part 4 applies: (a) regulation 12, (b) regulation 13, paragraph 3, (c) regulation 16. The master of a ship must ensure that a tank from which a noxious liquid substance has been unloaded is washed in accordance with the provisions of MARPOL, Annex II applying to the tank. The shipboard management plan and cargo record book must comply respectively with the requirements of section 22A(3) of the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 and with MARPOL, Annex II, Appendix II. Under Part 4 if a vessel has on board harmful substances in packaged form, the owner of the vessel must comply with MARPOL, Annex III, regulations 3–6. For MARPOL, Annex III, regulation 5, paragraphs 1 and 2, AMSA is the designated organisation.
Part 5 concerns sewage and greywater. The Part regulates discharge of sewage (excluding large ships) and identifies penalties and no discharge zones, these include all inland waters, aquaculture areas, marine parks within the meaning of the Marine Estate Management Act 2014, and aquatic reserves within the meaning of the Marine Estate Management Act 2014. Moreover the Part regulates sewage systems, sewage pollution prevention certificates, notification of accident and defect. Part 6 garbage, PArt 7 reporting, PArt 8 construction certificates.
