Abstract
The main purposes of this Act are as follows (a)to ensure particular substances are made, sold, used and disposed of in an appropriate, effective and safe way; (b)to ensure health risks arising from the use of the substances are appropriately managed; (c)to ensure persons who are authorised to carry out activities using the substances have the necessary competencies to carry out the activities safely.
The Act is organized in 9 Chapters and binds all persons, including the State and, as far as the legislative power of the Parliament permits, the Commonwealth and the other States. The Act provides for offences and exclusions from offences and defences, among the offences are included offences related to use of poisons and pest management. Chapter 3 concerns authorising regulated activities, among approved persons the Act identifies veterinary surgeon, moreover under the same Chapter a person is authorised to carry out a regulated activity with a regulated substance if the person is the holder of a substance authority that authorises the holder to carry out the activity. A substance authority is— (a)a manufacturing licence; or (b)a wholesale licence; or (c)a retail licence; or (d)a pest management licence; or (e)a prescribing approval; or (f)a general approval.
Chapter 4, Managing regulated activities, establishes requirements for carrying out regulated activities in the authorised way, administrative actions, among others. Chapter 5 monitoring and enforcement.

An Act to regulate activities in relation to particular substances, to repeal the Health Act 1937 and the Pest Management Act 2001, and to amend this Act, the Drugs Misuse Act 1986, and the Acts mentioned in schedule 2 for particular purposes.
