Abstract
The present Act makes consequential amendments arising from the enactment of the Nature Repair Act 2023. Schedule 2 amends the Clean Energy Regulator Act 2011 and the National Greenhouse and Energy Reporting Act 2007 adding a series of previsions that define and discipline biodiversity law and make reference to the sections of Nature Repair Act 2023, these encompass the definitions of Biodiversity Minister, Biodiversity Department and provisions related to biodiversity projects. Schedule 2 contains amendments to the Environment Protection and Biodiversity Conservation Act 1999 that substitute the expression coal seam gas developments with unconventional gas developments aiming at extending protection of water resources from additional kinds of developments; unconventional gas development under the Act means any activity involving unconventional gas production that has, or is likely to have, a significant impact on water resources (including any impacts of associated salt production and/or salinity): (a) in its own right; or (b) when considered with other developments, whether past, present or reasonably foreseeable developments.
