Abstract
This Regulation, consisting of 237 sections divided into ten Parts and completed by seven Schedules, implements the Water Management Act 2000. The Regulation is divided as follows: Preliminary (Part 1); Access licences (Part 2); Approvals (Part 3); Irrigation corporations (Part 4); Elections (Part 5); Private drainage boards (Part 6); Private water trusts (Part 7); Public works (Part 8); Water supply authorities (Parts 9); Miscellaneous (10). Schedules deal with: Excluded works (I); Stream order of a watercourse (II); Categories and subcategories of licences (III); Exemptions (IV); Forms (V); Floodplain (VI); Penalty notice offences (VII).
In particular, it deals with the following matters: Categories of access licence; Specific purpose access licences; Priorities between different categories of access licence; Available water determinations; Service of notices imposing conditions after licence or approval is granted; Applications generally; Applications for specific purpose access licences; Matters to be included in Water Access Licence Register; Nomination of water supply works and extraction points; Dealings on default; Circumstances in which Minister may refuse to accept surrender of access licence; Cancellation of specific purpose access licences; Register of available water determinations; Water allocation accounts; Requirements for consent by co-holders of access licences; Claims for compensation; and Determining value of water illegally taken.
