Abstract
The present Agreement provides for cooperation in protection of breeders’ rights, including cooperation in examination. Legal protection of plant variety shall be carried out according to the national legislation of the Contracting Parties and shall be documented by issuing patent (art. 3). Legal protection begins from the date of submitting application for legal protection of plant variety or from the date of publication thereof (art. 5). Exclusive rights to plant variety and transfer thereof shall be regulated by the national legislation of the Contracting Parties (art. 8). Protected plant variety can be used without prior consent of the paten holder in the following cases: (a) for experimental purposes; (b) for breeding of new plant varieties; (c) for personal non-commercial use (art. 9). Consent of patent holder shall be required in the following cases: (a) production and reproduction; (b) sowing; (c) trade; (d) export; (e) import; (f) storage for the above-mentioned uses (art. 10).

The Agreement entered into force on 27 May 2002.
Notes
The present Agreement shall be valid for five years and it will be automatically extended for one or more five-year periods, unless six months before its expiry one of the Parties informs the other, in writing, of its decision to terminate it.
