Abstract
This Law provides a complete set of rules aimed to regulate and define the fishing waters and all activities that can be performed, the correct and sustainable policies and measures for the use of fishing waters and fish fund, commercial fishing, sport fishing, aquaculture, protection of fish stock in fishing waters, fishery records, supervision and other issues related to the use of fishing waters and fisheries sector on the territory of the Republic of Srpska.
Fishing is an environmental, economic, community, educational and scientific activity which has to be implemented by integral protection, breeding, sustainable use and continuous improvement in technological and legal aspects.
The fish stock in fishing waters is a general interest wealth in the property of the Republic of Srpska and has a special care and protection.
The main objectives of this Law are: planning, efficient management and development of fish stocks and biodiversity in the fishing waters; sustainable use of fish stocks and respect the ethics of fishing; planning, promotion and supervision of breeding (aquaculture); development of fisheries and aquaculture and encouraging economic, environmental and social related activities; strengthening the development and competitiveness of enterprises in the field of fisheries.
These objectives can be reached by: conservation and protection of fish stocks, endangered fish species, variety (by monitoring the age, structure and size); planning the introduction and monitoring of new fish species in fishing waters; protection and preservation of the natural state of salmonid and cyprinid in waters; preserving the ecological integrity of aquatic ecosystems; ensuring the participation of stakeholders in decision acts and public access, accurate and timely information on the state of fisheries; harmonization of legislation of the Republic of Srpska with the legal acts of the European Council.
The Law is divided into XII Chapters and 90 articles, including the offences and related penalties.
