Abstract
This Law regulates the production, processing, labeling, and distribution of agricultural and other products derived through organic methods. It defines organic production as a management system based on biological processes and natural substances, strictly prohibiting the use of genetically modified organisms (GMOs) and ionizing radiation across all stages of the supply chain. The scope of the Law encompasses primary plant and livestock production, aquaculture, the collection of wild species, and the preparation of processed food and animal feed.
The regulatory structure emphasizes the maintenance of soil fertility, the preservation of biodiversity, and the protection of natural resources. Plant cultivation is required to be soil-based, utilizing multi-annual crop rotation and organic fertilizers to sustain land health. Livestock management is governed by high animal welfare standards, mandating access to open pastures, organic nutrition, and the use of natural veterinary treatments over synthetic alternatives. These methods aim to ensure that the biological integrity of the products is maintained from the initial cultivation to the final consumer.
A central component of the Law is the establishment of a transition process known as the conversion period, during which holdings must follow organic rules before their products can be officially marketed as organic. The Law also introduces mechanisms for group certification, allowing multiple producers to operate under a shared internal control system. To prevent consumer deception, the Law dictates strict labeling requirements, including the mandatory use of an official national logo and clear identification of the authorized control organization responsible for inspection.
Supervision and enforcement are managed through a system of official controls and mandatory registries for all participants in the organic sector. Authorized control organizations are tasked with conducting regular inspections and issuing certificates that verify compliance with the prescribed production methods. In instances of non-compliance, the Law provides a catalogue of measures and administrative penalties to address irregularities and ensure the continued credibility of organic designations within the market.
Furthermore, the Law addresses the administrative and operational requirements for trade and international exchange. It sets specific conditions for the import of organic products, requiring valid documentation to verify that imported goods meet standards equivalent to domestic regulations.
