Law No. 8.830 providing for the State Policy for Management and Protection of the Upper Paraguay River Basin in the State of Mato Grosso.

This Law, consisting of 19 articles divided into five Chapters, provides for the State Policy for Management and Protection of the Upper Paraguay River Basin in the State of Mato Grosso. The State Policy aims to promote the preservation and conservation of environmental assets, the improvement and recovery of environmental quality, in order to ensure sustainability and the well-being of the population complying with the following principles: precautionary; polluter pays; user-payer; prevention; participation and decentralization; ubiquity; river basin; fundamental human right; sustainable development; limit; protection of the Pantanal of Mato Grosso as National Heritage, Ramsar Site and Biosphere Reserve; recognition of traditional knowledge as a contribution to the development and management of the regional potentiality; respect and valorization for the use and management of environmental goods used by traditional peoples and communities; respect for biological diversity and associated values.
The basic guidelines of the State Policy are: governmental articulation of the state with the federal and municipal organs of environment, rural development, industry, trade, tourism and organized civil society; integration of environmental management with water resources and the management of land use; promotion of the necessary means for the participation of traditional peoples and indigenous communities in the social control and in the decision-making processes related to their rights and interests; ensure the individual and collective rights concerning traditional peoples and communities to self-determination in the construction of management policies in traditional territory; consolidate international, national, state, interstate and sectoral partnership for exchange information and integrate public policies articulated and applicable in the biome of Pantanal; regulate the territorial occupation of the Upper Paraguay River Basin, namely on the Planície Alagável (Floodplain); stimulate sustainable economic activities and support the existing ones; recognize, implement and promote sustainable activities developed by traditional peoples and communities; encourage actions related to the objectives of the Convention on Biological Diversity; encourage ecotourism as a way to generate employment and income and to control and protect the environment.
