Order INEMA No. 11.292 establishing documents and studies necessary for the application to INEMA of administrative acts for environmental regularity of activities within the State of Bahia.

This Order INEMA, consisting of 33 articles divided into three Chapters and five Annexes, establishes the documents and studies necessary for the application to the Institute of Environment and Water Resources (INEMA) of administrative acts for environmental regularity of activities to be carried out within the State of Bahia. Environmental control within INEMA will be done through the integration of authorizing acts of environment and water resources. The formalization of the processes for requesting the administrative acts depends on submitting to INEMA the related documentation listed in the Annexes. The documents presented to INEMA related to the environmental licensing or authorization processes are aimed at the analysis of environmental regularization and do not constitute, under any circumstances, possession or ownership. Declaratory acts listed below shall not be subject to renewal or extension of validity period, and, upon expiration, a new corresponding process shall be filed: a) Declaration of Controlled Burning (DQC); b) Declaration of Transportation of Hazardous Wastes (DTRP); c) Production Forestry Registry (RFP); d) Registry of Planted Forestry Exploitation or Logging (RCFP); e) Declaration of Intervention in Protected Area (DIAP).
The environmental licensing of enterprises and activities considered to be large users of forestry raw material are conditioned to the presentation of the forestry production capacity that ensures their supply, under the terms of Decree No. 15.180 of 2 June 2014. To request the right to use water resources, the interested party must submit the documents contained in Annex IV. Grant applications may be denied due to lack of water availability; for non-compliance with technical and/or legal requirements or for the public interest, by means of a duly substantiated decision. Annexes deal with the following matters: Documents Required for the Environmental Authorization and Licensing Processes; Studies Necessary to the Instruction of Processes of Authorization and Environmental Licensing; Documents and Studies Needed for the Instruction of Forest Processes; Documents and Studies Necessary to the Instruction of the Processes for Granting the Use of Water Resources; Documents and Studies Necessary to the Instruction of the Processes for Authorizations of Use and Wildlife Exploitation.
