Abstract
An Act to provide for cooperative development in Belize and the legal nature, structure, internal organization external relationships, etc. of cooperatives.
The Act consists of 125 sections divided into 13 Parts: Preliminary (I); Commissioner for Cooperative Development (II); Registration (III); Rights and duties of societies (IV); Rights and liabilities of members (V); Management and administration (VI); Property and funds (VII); Accounts and audit (VIII); Amalgamation and division (IX); Settlement of disputes (X); Liquidation (XI); Powers of Commissioner (XII); General (XIII).
The Minister shall appoint with a notice in the Official Gazette a Commissioner for Cooperative Development and may appoint a Deputy Commissioner or Assistant Commissioners as may be necessary to assist the Commissioner. The Commissioner shall register cooperative societies and ensure their compliance with provisions of this Act, encourage formation of cooperative societies and assist them in their operations, provide training and carry out other functions listed in section 5 or to be assigned by the Minister. The Commissioner may establish consultative procedures with the cooperative movement of Botswana. A society, which has as its principal object the promotion of the economic interests of its members in accordance with cooperative principles, or a society established with the object of facilitating the operations of such societies, and complying with the provisions of this Act, may be registered with or without limited liability (sect. 8). The Commissioner shall be responsible for the settlement of disputes among members, societies, etc. (sect. 92). The Commissioner may refer the dispute to arbitration. The Commissioner may also interfere in certain circumstances in internal matters of cooperative societies.
