Abstract
This Code defines: (a) acts that are administrative offenses; (b) grounds and conditions for administrative liability; and (c) administrative penalties and preventive measures that may be applied to individuals who have committed administrative offenses and legal entities subject to administrative liability in accordance with this Code. This Code is the only law on administrative offences in force in the national territory. The provisions of other legislative acts providing for administrative liability are an integral part of the legislation on administrative offences and are subject to application taking into account the provisions of this Code and inclusion in it. Administrative liability must be fair. No one may be held administratively liable twice for the same administrative offence. An individual who has reached the age of sixteen at the time of committing the offense is subject to administrative liability. An individual who has committed an offense at the age of fourteen to sixteen years is subject to administrative liability only for, inter alia, for cruel treatment of an animal or disposal of an animal. The following acts containing elements of the following administrative offences shall entail administrative liability: (a) consumer fraud; and (b) unfair competition; (c) infringement of the rules of trade and public catering; (d) infringement of the rules of spirit processing, declaration, storage, fraud and trade; (e) storage, movement across the national territory by an individual of more than two kilograms of poppy seeds not packaged in special packaging, violation of rules on quarantine and plant protection; (f) violation of general requirements in the field of environmental protection environmental norms and rules or regulations; (g) violation of requirements for the protection and use of wild animals and wild plants related to species included in the Red Book of endangered species of the Republic of Belarus, their habitats and growth, illegal export from the Republic of Belarus or import into it of wild animals, wild growing and other plants, their parts or derivatives, trade of which is regulated by international treaties of the Republic of Belarus, or illegal export from the Republic of Belarus of wild animals, wild growing and other plants related to species included in the Red Book of endangered species of the Republic of Belarus; (h) violations of forest management rules; (i) illegal hunting; (j) violation of the rules of veterinary practice, keeping of animals and identification of farm animals; and (k) violation of rules on water management.
