Abstract
This Decree regulates relations regarding organization by legal person, individual entrepreneur of market, including the procedure for issuing a permit for its creation, termination of its activities, the requirements for equipment, maintenance of markets, trade of commodities on trading places, the procedure for providing trading places, forming and maintaining the register of sellers and the register of contracts for the provision of trading places. Authorization for organization and functioning of market must contain information related to the number of trading places for trade of agricultural products and fish-farming products without industrial processing by the producers of such commodities, including natural persons that are smallholders or engaged in gardening, horticulture, animal husbandry. Market must comply with sanitary and hygienic requirements. For the sale of vegetables and fruits (including processed form by salting, fermentation, drying), other crop production (except for ornamental plants and floriculture products), fermented milk and dairy products (including processed form), beekeeping products, other products of animal origin (except for furs), obtained from domestic animals (cattle, pigs, horses, sheep, goats, rabbits, poultry), either live or products of slaughter in raw or processed form the vendor must submit certificate issued by the local executive and administrative body in accordance with the established form, a certificate confirming that the products subject to vending have been produced by an individual, a natural person, and/or persons closely related thereto (parents (adoptive parents), children (including adopted), brothers and sisters, grandfather, grandmother, grandchildren, great-grandmother, great-grandchildren, spouses) or relatives (close relatives of the other spouse, including the deceased), tutor, trustee and wards, on the land located on the territory of the Republic of Belarus, provided for the construction and maintenance of an apartment building and smallholding, collective gardening, suburban construction, horticulture in the form of official land allotment. For the sale of beekeeping products manufactured on the territory of the Republic of Belarus, along with the certificate specified in part four of this subparagraph, or instead of it (in the case when the apiary is not located on those land plots that are in accordance with the established modalities allotted to the physical person vending beekeeping products manufactured thereby) must be submitted veterinary-sanitary certificate of the apiary, issued on the territory of the Republic of Belarus, and (or) other form of certificate issued on the basis of the previously mentioned certificate. This Decree prohibits the sale of live animals and plants, as well as their parts and derivatives, related to species included in the Red Book of the Republic of Belarus, as well as those subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.
