Ministerial Decree No. 89 implementing Ministerial Decree No. 1397 on some issues of transboundary movement of waste.

This Ministerial Decree establishes the modalities of filling in notification form on transboundary movement of waste by legal persons and individual entrepreneurs carrying out transboundary movement and transit of waste. Notification shall contain a copy of contract (agreement) between exporter and legal person (individual entrepreneur) authorized to carry out disposal (management, treatment) of waste on the territory of the importing state. The contract must contain the following specifications: (a) objective of the contract; (b) date of expiry and periodicity of shipping; (c) description of waste, including chemical composition; (d) amount of waste; (e) specification and weight of packaging; (f) description of technological process of management (treatment); (g) transfer of ownership right of waste; (h) actions of the parties in case of the impossibility of acceptance of waste; (i) duty to inform exporting and importing authority; (j) duty of re-shipping of waste within 90 days from the date of acceptance in case of impossibility of management (treatment) on the territory of the importing state; and (k) duty of compensation in the form of revenue to state budget in case of damages caused in the process of export and import of waste.
