Abstract
This Ministerial Decree establishes the modalities of the issuance of permits for export and import of waste by the Ministry of Natural Resources and Environmental Protection. The aforesaid permit shall be issued for once-only transboundary movement or for multiple transboundary movements if waste materials have the same physical and chemical qualities or being moved by the same person. A new permit shall be issued upon expiration of permit currently in force. The applicant shall submit the following documentation: (a) certificate of payment of state dues and taxes; (b) service certificate; (c) state registration certificate (for individual entrepreneurs); and (d) identity paper. This Decree shall be also applicable to transboundary movement of ozone depleting substances authorized for export and import in conformity with permits issued by the Ministry of Natural Resources and Environmental Protection. The Regulation on the procedure and conditions for issuing permits by the Ministry of Natural Resources and Environmental Protection for movement across the customs border of the Republic of Belarus of species of animals and plants, their parts or derivatives thereof, covered by the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed in Washington on March 3, 1973 (CITES), restricted from movement across the customs border of the Republic of Belarus on non-economic grounds establishes the procedure and conditions for issuing permits by the Ministry of Natural Resources and Environmental Protection for movement across the customs border of the Republic of Belarus of the aforesaid species. This Regulation applies to legal entities and natural persons, including individual entrepreneurs, importing CITES specimens into the customs territory of the Republic of Belarus and (or) exporting them outside it. To obtain a CITES permit, the applicant shall submit to the Ministry of Natural Resources and Environmental Protection an application in the form according to Appendix 1 and other documents. In case of export of live wild animals that are CITES specimens, the Ministry of Natural Resources and Environmental Protection has the right, within its competence, to check compliance with the requirements for their transportation. The applicant is denied a CITES permit in the following cases: (a) the application is filed in violation of the established form; (b) the documents required to obtain it are not submitted; and (c) the submitted documents contain false information. The Ministry of Natural Resources and Environmental Protection registers the issued CITES permit in the permit registration log. A separate CITES permit is issued for each batch of CITES specimens of one species. The validity period of the CITES permit may not exceed 6 months from the date of its issue.
