Presidential Decree No. 240 “On administrative procedures carried out in relation to business entities.”

The President, in order to streamline the regulation of business and other economic activities, as well as to further improve the procedure for carrying out administrative procedures, decrees to determine that the principles for implementing administrative procedures in relation to business entities (legal entities and individual entrepreneurs) are: (a) availability and priority of taking into account the interests of business entities; (b) the inadmissibility of refusal to accept an application from a business entity and carry out an administrative procedure on grounds not provided for by legislative acts, resolutions of the Council of Ministers of the Republic of Belarus and resolutions of the Board of the National Bank; (c) determination of the list of documents and (or) information submitted by a business entity to carry out an administrative procedure; (d) ensuring the greatest possible convenience in carrying out administrative procedures, including through consolidation in the “one window” service; (e) maximum use of information technology in the process implementation of administrative procedures, including by converting them into electronic form; and (f) proportionality of the general administrative burden on business entities to the actual needs of regulating business and other economic activities through the implementation of administrative procedures. Regulatory body shall be intended a state body, other organization, including those not subordinate to the Council of Ministers of the Republic of Belarus, whose competence includes the implementation of state policy in the relevant area of public relations. The Ministry of Economy shall be responsible for the registration of information and data related to business entities and individual entrepreneurs, and keeping the state register. This Presidential Decree shall not be applicable to the following fields: (a) specific goods related to works and services; (b) expropriation and allotment of land plots; (c) ensuring nuclear and radiation safety; (d) liquidation of the consequences of emergency situation; (e) state secrets; and (f) registration and liquidation (cancellation) of business entities and individual entrepreneurs.
