Resolution No. 828 of the Council of Ministers validating the Regulation on botanical collections.

This Regulation defines the legal regime of botanical collections, the procedure for their creation, issuance of a certificate of a botanical collection, replenishment, maintenance, storage, import and export, exhibition and trade in them, as well as recognition of botanical collections as particularly valuable. Botanical collection shall be intended a systematized collection of documented (labelled or otherwise individualized) preserved, including cultivated plants and (or) their parts, which has scientific, educational, cultural, historical and aesthetic value (a collection of living plants outside their natural growing environment (in ex-situ conditions), herbariums, seed banks, etc.). Only legal persons can be owners of botanical collections. Legal entities and citizens may create a botanical collection by removing plants from their natural habitats, acquiring them on the basis of a purchase and sale agreement, exchange, gift or other transaction on their alienation, as well as by separating part of a botanical collection from another and acquiring documented plants from other botanical collections or otherwise in accordance with the law. The creation of botanical collections must be carried out in compliance with the requirements of legislation on environmental protection, protection of flora and fauna. The right of ownership of a botanical collection is acquired by the person who created it. The owner of a botanical collection included in the register is issued a certificate of botanical collection by the Ministry of Natural Resources in the form in Appendix 1. The grounds for inclusion of a plant collection in the register and issuance of a certificate of a botanical collection are: (a) compliance of the plant collection with the characteristics of a botanical collection; (b) ensuring the safety of the botanical collection by the owner of the plant collection; and (c) creation and replenishment of the plant collection in compliance with the requirements of legislation on environmental protection and rational use of natural resources. Annex 1 contains the form of certificate on botanical collection. Annex 2 contains the form of certificate on acknowledgement of botanical collection as particularly valuable. Annex 3 contains the form of Protection Commitment of a particularly valuable botanical collection.
