Abstract
The Seeds Regulations, under the Seeds Act, provide a comprehensive legal framework for the regulation of seed quality, testing, inspection, sale, import, and export in Canada. The regulations are designed to ensure that seeds sold, imported, or exported in Canada meet specific standards for purity, germination, and varietal identity. The document is structured into several parts, each addressing different aspects: general provisions and definitions; standards and exemptions for various seed types (including field crops, forage, lawn, and vegetable seeds); detailed requirements for seed potatoes; procedures for variety registration; and the registration and licensing of establishments and operators involved in seed conditioning, storage, and importation. The regulations also include provisions for the release of seeds with novel traits, outlining risk assessment and authorization processes to protect human health and the environment.
The regulations set out detailed standards for seed grading, labelling, sampling, and testing, including minimum germination rates, maximum allowable weed seeds, and requirements for seed mixtures. The regulations establish procedures for the registration of new plant varieties, including eligibility criteria, required documentation, and review processes. Establishments that process or store seeds must be registered and meet specific operational, record-keeping, and equipment standards, with annual renewals and compliance checks. The document also provides for the suspension or cancellation of registrations and licenses in cases of non-compliance, and outlines the process for notification and authorization of the release of seeds with novel traits, including ongoing obligations to report new risk information. Extensive schedules provide technical details on seed standards for a wide range of crops
