Abstract
This Act governs the regulation, quality, and trade of seeds within Canada. Its primary aim is to ensure that seeds sold, imported, or exported meet prescribed standards for purity, germination, and varietal identity, thereby protecting agricultural integrity and public health. The Act empowers the Minister of Agriculture and Agri-Food to designate accredited laboratories, issue export certificates, and incorporate external documents by reference into regulations. It also outlines the responsibilities of inspectors and analysts, and provides mechanisms for enforcement, including seizure and recall of non-compliant seeds.
The Act prohibits the sale, importation, or exportation of seeds that do not conform to established standards or that are not properly labeled and registered. It includes provisions for the classification of seeds, licensing of seed-related activities, and the establishment of regulations governing seed testing, packaging, and marketing. Inspectors are granted authority to enter premises, examine seeds, take samples, and enforce compliance. The Act also addresses the handling of harmful seeds and outlines procedures for their removal or destruction if they pose risks to human, animal, or environmental health.
At the operational level, the Act details offences and penalties for violations, including fines and imprisonment. It provides legal protections for inspectors and analysts acting in good faith and specifies the admissibility of analyst certificates in legal proceedings. The Act also includes provisions for the forfeiture of non-compliant seeds and outlines the jurisdiction for legal complaints.
