Abstract
These Regulations, made under sections 6 and 92 of the Marine Resources Act 2005, regulate purse seine fishing and related activities in the fishery waters of the Cook Islands. All purse seine fishing shall be done in accordance with the Act, with Regulations and with the purse seine fishing vessel licence issued by the Minister, the Secretary of Marine Resources or an administrator of a multilateral treaty to which the Cook Islands is a party. The Purse Seine Fishery shall be declared under section 6 of the Act, and a Fishery Plan prepared by the Secretary under section 6 of the Act shall come into force on the same day as these Regulations.
The Regulations also provide transhipment of fish and for the protection of non-target species (including sharks), and specify criteria for licences and conditions for fishing. The Secretary may give directives regarding, among other things, monitoring and surveillance, return of fish to sea, impact of fishing operations on the environment and record-keeping. In protection of non-target species reference is made to FAO and other international (regional) standards.
