Abstract
The Act consists of 32 sections divided into 5 Parts: Importation (I); Disease control (II); Plant control (III); Powers of inspectors (IV); Miscellaneous provisions (V).
The Director of Agriculture may declare quarantine stations pursuant to section 4 and the Minister may appoint ports of entry for plant material or any specified plants. The Minister may further prescribe various other matters relating to storage and inspection of imported plant materials or any specified class of plant material. Section 6 concerns emergency restrictions on importation, whereas section 7 concerns importation for scientific research. Regulation making powers of the High Commissioner are set out in section 10. Occupiers of land shall follow directions of inspectors regarding the eradication of diseases affecting plants (sect. 11). The High Commissioner may proclaim plant disease emergencies pursuant to section 12. Emergency powers are defined in section 13. Section 15 concerns control by the Director of Agriculture of exportation of plant material. The Director may direct a grower not to submit crop affected by a disease for exportation. Section 28 prescribes offences. Further Regulation making powers are of the High Commissioner are specified in sections 16 and 31.
