Abstract
This Act provides for (the administration of) biosecurity measures in relation with importation and exportation of animals and plants conducted by persons present in the Cook Islands. This Act shall also apply to persons, conveyances, containers and goods outside the Cook Islands to the extent needed for its effective enforcement. The Act also deals with biosecurity emergencies.
The Director of Biosecurity may declare the pests or diseases:(a) the importation of which is prohibited for all purposes; (b) the importation of which is permitted subject to conditions specified by the Secretary to the Ministry of Agriculture. The Director may also place restrictions on the importation of regulated articles, including (a) any animal or fish product; (b) any plant or plant product; (c) any living organism, whether modified or not; (d) soil, sand, gravel and aggregate; (e) any genetic material; and (f) a regulated pest or disease. Other matters regulated by this Act include: biosecurity quarantine; declaration of biosecurity emergency area; status and functions of the Biosecurity Service and administration in general; and biosecurity internal control.
