Abstract
This Regulation is formulated to ensure food safety and protect the health and life safety of the public. The Regulation is based on the Food Safety Law and the Agricultural Product Quality and Safety Law of China and is tailored to the province's specific circumstances. It governs the production, busiess operation and safety management of food, food additives and food-related products, the use of food additives and food-related products, the storage and transportation of food, and the market sales of edible agricultural products within the administrative area of Guangdong province.
The Regulation, consisting of 6 Chapters and 75 Articles, makes provisions on food production and business operation, food safety assurance, supervision and administration, legal liabilities and other aspects. Key provisions include the establishment of food safety management systems by food relevant units, which must implement self-inspection, raw material control, and sanitation protocols. Food service providers must be licensed and are responsible for ensuring food safety. The Regulation also addresses online food trading, requiring platforms to fulfill their obligations as third-party service providers and ensure compliance from food operators. The provincial government is tasked with establishing a food safety risk monitoring and assessment system, enhancing capabilities in these areas, and ensuring accurate data collection. The Regulation emphasizes a preventive approach to food safety, advocating for risk management and comprehensive control throughout the food supply chain. It also highlights the importance of social participation in food safety governance, establishing a framework for cooperation among producers, regulatory bodies, and the community. The Regulation stipulates that consumer associations and other consumer organizations shall safeguard the legitimate rights and interests of consumers in food safety in accordance with the law; food industry associations shall establish industry norms, organize and carry out industry integrity construction, strengthen industry self-discipline management, guide, standardize and urge members to conduct production and operation in accordance with the law; news media shall strengthen public welfare publicity of food safety laws, regulations, food safety standards and knowledge, and conduct public opinion supervision on food safety; volunteer organizations are encouraged to assist or participate in food safety publicity and education, social supervision and other work.
