Measures for the administration of food business operation licensing.

These Measures are developed in accordance with the Food Safety Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, aiming to regulate the licensing for the food business operations, strengthen the supervision and administration of food business operations, and ensure food safety. The Text consists of 8 Chapters: General Provisions (I); Application and Acceptance (II); Examination and Decision (III); License Management (IV); Change, Renewal, Reissuance and Cancellation (V); Supervision and Inspection (VI); Legal Liabilities (VII); Supplementary Provisions (VIII).
A food business operation license shall be obtained in accordance with the law to engage in food sales and catering services in P.R. China (art.2). Food and drug regulatory authorities shall implement categorized licensing for food business operations on the basis of the degree of food risks (art.5). The China Food and Drug Administration shall take charge of the supervision over and guidance to the nationwide food business operation licensing administration (art.6). The Measures provide further for the procedures, conditions and requirements for food business operation licensing, and the measures for supervision and inspection, offences and penalties.
