Abstract
The purpose of these Measures is to regulate the norms and behavior of farmers’ cooperatives, protect the legitimate rights and interests of such organizations and their members, guide and support the development thereof. The Text consists of 37 articles divided into 6 Chapters: General Provisions (I); Establishment and Operation (II); Guidance and Services (III); Support Measures (IV); Legal Liabilities (V); Supplementary Provisions (VI).
The producers and operators of similar agricultural products or the service providers of similar agricultural production and operation, who are willing to be engage in the following activities jointly, may apply for the establishment of the farmers’ specialized cooperatives: (a) farming, forest, livestock breeding and aquaculture; (b) marketing and processing, storage and transport of agricultural products; (c) agricultural technology services; (d) agriculture machinery services; (e) the rural family handicrafts; (f) other mutual agricultural production and services. A specialized farmers’ cooperatives shall be registered by the Industrial and Commercial Administration according to law, in order to receive business license and obtain legal personality (art.9).
Specialized farmers' cooperative members are encouraged to transfer land contract and management rights thereof to the cooperatives through subcontracting, leasing and other forms, and get cooperative shares to expand the scale of agricultural production and increase income (art.11).
Specialized farmers' cooperatives may develop credit cooperation to provide financial support for the members (art.12).
