Abstract
This Law aims at regulating the organization and conduct of farmers' professional cooperatives, encouraging, supporting and guiding the development of farmers' professional cooperatives, protecting the lawful rights and interests of farmers' professional cooperatives and the members thereof, and advancing agricultural and rural modernization. This Law consists of 10 Chapters divided into 74 articles: General Provisions (I); Establishment and Registration (II); Members (III); Organs (IV); Financial Management (V); Merger, Split, Dissolution and Liquidation (VI); Unions of Farmers' Professional Cooperatives (VII); Supportive Policies (VIII); Legal Liability (IX); Supplementary Provisions (X).
The Law states the principals to be abided by specialized farmers’ cooperatives. The State shall protect the legal rights of such cooperatives and their members. A farmers' professional cooperative shall be registered and obtain the status of legal person under this Law. The Law further provides for the conditions on establishment and registration of cooperatives. As regards the organization of cooperatives, the Law stipulates the functions and power exercised by the membership assembly of a specialized farmers’ cooperative.
