Abstract
These Measures are formulated in accordance with the Fisheries Law of the People's Republic of China, aiming to strengthen the protection, increase, development and reasonable utilization of fishery resources, develop aquaculture, safeguard the legitimate rights and interests of fishery producers, and promote the sustainable development of fishery production. The Text consists of 50 Articles divided into 6 Chapters: General provisions (I); Aquaculture (II); Fishing (III); Increase and protection of fishery resources (IV); Legal liabilities (V); Supplementary provisions (VI).
The local people's governments at various levels shall strengthen the unified planning and comprehensive utilization of water areas, vigorously develop the aquatic product processing and circulation sector, and promote industrialized management (art.7). Legally obtained rights of use of sea and inland waters for aquatic breeding or contractual aquaculture operation rights shall be protected by law, and may be transferred or leased (art.14).
The Text further addresses the issues of planning of water areas devoted to the development of aquaculture, rules and requirements to be satisfied by any entity or individual engaged in the production of aquaculture or aquatic fingerlings, certification of the origin of pollution-free aquatic products, fishing authorization, enforcement, conservation measures, fishery resource protection and enhancement fees, and offences.
