Measures of Hainan Province for the Implementation of the Fisheries Law of the People's Republic of China.

These Measures are formulated in order to strengthen the protection, increase, development and reasonable utilization of fishery resources, safeguard legitimate rights of fishery producers, ensure the quality and safety of aquatic products, and promote the healthy and sustainable development of fisheries. The Text consists of 41 Articles divided into 7 Chapters: General provisions (I); Supervision and administration on fisheries (II); Aquaculture (III); Fishing (IV); Increase and protection of fishery resources (V); Legal liability (VI); Supplementary provisions (VII).
The people's governments at various levels shall strengthen the unified planning and comprehensive development and utilization of fishery waters, and take charge of supervision and inspection on fisheries laws and regulations (art.4). The Text addresses the issues of aquaculture certificates, rules and requirements to be satisfied by any entity or individual engaged in aquaculture, fishing authorization, enforcement, conservation measures, offences and penalties, etc. Fishery production or fishery resources survey activities to be carried out by foreigners, foreign fishing vessels in waters under the jurisdiction of this province shall be approved by the competent department of the State Council (art.35).
