Provisions on the administration of Pelagic Fisheries.

These Provisions are enacted for the purpose of strengthening the administration of pelagic fishery, maintaining the lawful rights and interests of the state and those of pelagic fishery enterprises and their practitioners, protecting and rationally utilizing marine fishery resources, and promoting the sustainable and healthy development of pelagic fishery. These Provisions consist of 44 articles divided into 8 Chapters: General provisions; Application for and approval of pelagic fishery projects; Qualification and annual review of pelagic fishery enterprises; Ocean-going fishing vessels and crews; Safe production; Supervision and management; Legal liabilities; Supplementary provisions.
Enterprises that meet the conditions prescribed in Article 8 may engage in pelagic fisheries and apply to carry out pelagic fishery projects. For those engaged in high seas fishing operations, the Ministry of Agriculture and Rural Affairs shall issue the "High Seas Fishery Fishing Permit" at the same time when approving the pelagic fishery projects. A pelagic fishing vessel in order to engage in pelagic fishery production shall pass a technical inspection, be legally registered with the fishing harbour supervision department, obtain the relevant certificates, and conform to the administrative provisions in the laws and regulations of China as well as the relevant international treaties . The fishery administrative department of the people’s government shall take charge of the planning, organization, supervision and administration of pelagic fishery.
