Abstract
The purpose of these Provisions is to strengthen the on-water safety management of fishing vessels, and standardize the reporting, investigation and handling of on-water safety accidents of fishing vessels. The Provisions consist of 41 articles divided into 6 Chapters: General Provisions (I); Accident Reporting (II); Accident Investigation (III); Accident Handling (IV); Mediation (V); Supplementary Provisions (VI).
Fishery administrative department of the people's government at or above the county level and their subordinate fishery administration and fishing port supervision and management agencies (hereinafter referred to as the fishing vessel accident investigation authority) shall be responsible for on-water fishing vessel safety accident reporting. Fishing vessel safety accident reporting shall be timely, accurate and complete. For the on-water safety accidents of the vessels and installations which occur in the waters of a fishery harbour, the accident investigation authority of the location of fishery harbours shall be in charge of the accident investigation. Regarding to the civil disputes caused by safety accidents of fishery vessels, the parties concerned may, within 30 days from the date of the accident, apply for mediation in writing to the fishing vessel accident investigation authority.
