Abstract
These Regulations, consisting of 46 Articles divided into 5 Chapters, are formulated for the purpose of implementing the Law of the People’s Republic of China on Specialized Farmers’ Cooperatives.
The producers and operators of similar agricultural products or the service providers of similar agricultural production and operation, who are willing to be engage in the following activities jointly, may apply for the establishment of the farmers’ specialized cooperatives: (a) farming, forest, livestock breeding and aquaculture; (b) marketing and processing, storage and transport of agricultural products; (c) agricultural technology services; (d) the rural public water supply services; (e) agriculture machinery services; (f) ecological tourism and rural folklore tourism; (g) the rural family handicrafts; (h) other agricultural production and business activities(art.8).
These Regulations address the establishment and operation of specialized farmers’ cooperatives and the relevant issues of management and administration, guidance, support and services, offences and penalties, etc.
For establishment of a specialized farmers’ cooperative, an application for establishment registration shall be made to the competent authority and the business license of the specialized farmers’ cooperative as a legal person be obtained according to law (atr.9).
