Abstract
These Regulations are formulated to ensure the food safety and safeguard the public's health and life safety. The Regulations are based on the Food Safety Law of China and is tailored to the Municipality's specific circumstances.
The Regulations govern the production operation of food, food additives and food-related products, the food producers' use of food additives and food-related products, the food storage and transportation, and the safety management of food, food additives and food-related products in Shanghai Municipality. The Regulations consist of 115 Articles divided into 8 Chapters: Chapter I General Provisions; Chapter II Food Safety Risk Monitoring, Assessment and Food Safety Standards; Chapter III Food Production Management (Section 1 General Provisions on Market Access; Section 2 Production Process Control; Section 3 Edible Agricultural Products; Section 4 Internet Food Management.); Chapter IV Food Production and Processing of Small Workshops and Food Vendors; Chapter V Prevention and Disposal of Food Safety Accidents; Chapter VI Supervision and Management; Chapter VII Legal Liability; Chapter VIII Supplementary Provisions.
The Regulations establish a comprehensive framework for food safety management, detailing the responsibilities of various governmental bodies, including the municipal and district food and drug safety committees. The overarching objective is to prevent food safety incidents through stringent oversight, effective coordination among agencies, and the promotion of consumer awareness regarding food safety standards. The Regulations seek to build a robust and transparent food safety system leveraging technology, strict oversight, and severe penalties to protect public health. The Regulations introduce comprehensive measures to enhance food safety and management, including: 1. Market Access and Traceability: Strict thresholds for market entry to prevent substandard food from entering the supply chain; A city-wide food safety information registration and traceability system shall track key food products using modern technologies like big data. 2. Enterprise Responsibilitie: Enterprises must adhere to strict food safety standards in production, processing, and distribution; Specific focus areas include wholesale trading of agricultural products, shelf-life management, and food safety grading for catering services. 3. Online Food Operations: The Regulations make provisions covering third-party food trading platforms, independent food sellers, and delivery services, strengthening oversight which includes filing requirements, publicity obligations, and delivery management. 4. Food supervision focuses on foods like alcohol, edible salt, and grains, as well as rural collective dining facilities. 5. Risk Monitoring and Penalties: plans for food safety risk monitoring, emergency response, and incident handling; harsh penalties for violations, including lifetime bans for offenders convicted of serious food safety crimes. Additionally, the Regulations emphasize the importance of public education on food safety, encouraging community involvement and the dissemination of knowledge through various media channels.
