Abstract
These Measures are formulated in accordance with the Food Safety Law of the People's Republic of China and its implementing regulations, the Shanghai Food Safety Regulations, the Measures for the Administration of Supervision and Inspection of Food Production and Operation, and other laws, regulations and relevant rules, aiming to strengthen the quantitative and graded management of food sales risks, standardize food sales and business operations, implement scientific and effective supervision, improve the effectiveness of food safety governance, and ensure food safety.
The Interim Measures create a four-tier A–D system for all licensed food sellers and pre-packaged-only vendors. Static factors (premises area, product type, sales channel) supply up to 40 points; dynamic factors (inspection non-conformities, failed tests, recalls, penalties, management turnover) supply up to 60. Totals 0–40 = A, 41–55 = B, 56–70 = C, >70 = D; serious violations or accidents trigger D. Grades dictate inspection frequency: A. every two years; B. annually; C. twice a year; D. thrice. Shanghai Municipal Administration for Market Regulation adjusts grades dynamically via integrated databases; sellers can lower their grade after three consecutive clean years or recognised certifications such as HACCP. District bureaus must publish annual plans, expand remote oversight and link grading to food-safety accountability mechanisms.
