Abstract
This Protocol regulates the imposition of licence fees in accordance with comma of Article IV of the Eastern Pacific Ocean Tuna Fishing Agreement. If the Agreement enters into force with five Contracting Parties, the licence fee shall be sixty United States Dollars per net registered ton of the vessel for which a licence is requested. This fee shall be increased by at least ten dollars, up to a maximum of hundred dollars per net registered ton, for each additional Contracting Party that is a Coastal State in the sense of the Agreement. Likewise, the fee shall be decreased upon withdrawal of a Contracting Party that is a Coastal State. In doing so, regard shall be had to the quantity of tuna taken within a two hundred nautical miles zone of the withdrawing Coastal State. Licences shall not be required of vessels of a net registered tonnage of less than 200 tons which fish exclusively within two hundred nautical miles of the baselines from which the breadth of the territorial sea is measured of their flag State. Funds obtained from the collection of fees shall be redistributed by the Council between Coastal States in accordance with the formula laid down in comma (F) of this Protocol.
