Abstract
This Decree-Law, consisting of 61 articles divided into seven Chapters, establishes the Legal Regime for Extraction of Aggregates. It is applicable to extractive operations of aggregates in the dunes, in the coastal strip and in the territorial sea, as well as in the streams. In addition, it regulates licences, fees sanctioning regime, and derogation, in the applicable part, from the Regulation of the Basic Law of Environmental Policy, approved by Legislative Decree No. 14/97 of 1 July, namely with regard to the competent authority for the application of the fine, and sanctions for exploitation of aggregates for civil construction without a licence, in violation of the conditions provided for in the law and in violation of technical, hygiene, safety and environmental protection measures and landscape recovery. Amendments of Decree-Law No. 2/2002 of 21 January specify the ban on the extraction of sand from dunes, beaches, inland waters, the coastal strip and the territorial sea to a depth of 10 meters.
