Abstract
This Law provides for harmonising Cypriot Legislation with the provisions of the European Directive 2014/24/EU of 2014 on public procurement procedures. The Law defines the following terms: contracting authorities; label requirements; Competent Public Procurement Authority; public contracts; public supply contracts; public works contracts; public service contracts; procurement procedure or contract; online certificate repository; purchasing activity; electronic equipment for processing and storage of data; innovation; central government authorities; economic operator; Government Procurement Agreement of World Trade Organization; framework agreement. This Law aims at establishing rules for the award procedures carried out by contracting authorities for public contracts and for design contests, with a defined threshold value. The Law concerns the following matters: principles applicable to procurement procedures; confidentiality; conflict of interests; types of contracts and exclusively awarded contracts; defined thresholds according to the contracts; methods for calculating the estimated contract value; contracts in water, energy, transport and postal services sectors excluded from the application of this Law; specific exceptions in the field of electronic communications; exceptions for service contracts; public contracts between public sector entities; contracts subsidised by contracting authorities; contracts in research and development services; defence and security contracts; public contracts and design contests relating to defence and security and awarded or organised in accordance with international rules.
Part II of the Law concerns rules applicable to public procurement and focuses on the following matters: conditions related to the World Trade Organization Agreement on Government Procurement and other international agreements; selection of procedures; open and closed procedures; competitive procedure with negotiation; innovation partnership; techniques and tools for electronic and concentrated procurement procedures; procurement procedures involving contracting authorities from different Member States; subdivision of contracts into parts; publicity and transparency; information to candidates and tenderers; selection of participants and award of contracts; quality assurance and environmental management standards; official lists of approved economic operators and certification by public or private law organisations; contracts award criteria; terms of execution of the contract. Part III concerns special contract measures and focuses on the following: contracts for social and other special services; exclusive contracts for social and other special services; rules governing design competition. Part IV concerns governance, enforcement measures; separate reports on procurement procedures. Part V covers the following matters: contracts with an estimated value below the minimum amounts; notification of a concluded contract. Part VI concerns offences and penalties.
