Abstract
The Regulations, issued under Articles 12(3) and 22(2)c of the International Convention on the Prevention of of the Pollution of the Sea by Ships and for the purpose of harmonisation with articles 1 to 16, with article 22 and with Annexes 1 to 5 of the Directive (EU) 2019/883 of the European Parliament and of the Council regarding the port reception facilities for the delivery of waste from ships, provide for the protection of the marine environment from the negative effects of the discharge of waste from ships using ports and marinas; for ensuring the smooth operation of maritime traffic, by improving the provision and use of adequate reception facilities established by the International Maritime Organisation; for the delivery of waste from ships to said facilities. The Regulations define the following relevant terms: fishing vessel; fishing refuge; waste from ships; bycatch waste; processing; indirect fees; port and port service; wastewater; petroleum-like substances.
The Regulations apply: in water and land reception facilities; to all ships, regardless of flag, sailing or operating in a port or fishing sanctuary or in a marina; in all fishing sanctuaries and in all marinas. Matters covered by these Regulations concern: identification of reception facilities for oily waste from ships and oily cargo residues, including: waste reception facilities and related operations, reuse and recycling of waste, compliance with European legislation on disposal of animal by-products and derived products not intended for human consumption, prevention of risks to persons or the environment in ports, marinas and fishing sanctuaries; marine equipment of floating reception facilities; preventive measures for marine protection environment, including: pollution emergency plan, restoration of the environmental damage in case of accidents, approved oil recovery means and materials, and approved type of chemical dispersant; operation of sewage and waste reception facilities other than petroleum waste, including: avoiding pollution of the sea; obligation of vessels for delivery of waste, including: waste collection and management plan.
