Act on the Comprehensive Reform of Food Law.

This legislative Act, represents a comprehensive reform and reorganization of the law governing the commercial trade of foodstuffs, tobacco products, cosmetic products, and various other consumer goods and articles of daily use including substances with a pharmacological effect (four core categories). The Act aims to ensure consumer protection, both proactively for public health and reactively against misleading practices and deception in commerce. The Act is thematically structured into sections, beginning with precise Definitions for the four core product categories. The central substance of the law is then addressed in specific sections for each product area, where detailed Prohibitions (particularly regarding unauthorized additives, contamination, and misleading advertising) are complemented by extensive Authorization Powers granted to issue legal ordinances for flexible standard setting in areas like hygiene and labeling. Further provisions regulate the Official Supervision by competent regional authorities, defining procedures for sampling and duties of cooperation. The Act also establishes supportive bodies like the German Food Code Commission and includes final regulations on Cross-Border Traffic. Strict adherence is enforced through a catalog of Criminal Offenses and Regulatory Offences and related forfeiture provisions, followed by the obligatory transition and final clauses. The Act consists of 55 Articles divided into 9 Parts. The Act contains an Attachment on "the Reference to European Community legislation which, by virtue of its publication in the Official Journal of the European Communities, has become legally binding in the Federal Republic of Germany", that acknowledges legal provisions of the European Communities that were relevant to the national law's subject matter were being published concurrently.
