Abstract
The law outlines the legal framework for waste management in Hessen province. The law is structured into several parts, detailing the responsibilities of public waste management authorities and the procedures for waste disposal and recycling. The first part addresses the role of publicly mandated waste management entities, which are responsible for collecting and processing waste generated within their jurisdictions. It emphasizes the need for these authorities to establish necessary collection systems and facilities to ensure proper waste disposal, including the separate collection of small quantities of hazardous waste. The second part focuses on the implementation of waste disposal practices, mandating that municipalities create waste management concepts and plans. It outlines the obligations of public authorities to manage waste effectively, including the establishment of collection points for hazardous waste and the regulation of waste disposal through local statutes. Additionally, the law stipulates that municipalities are responsible for addressing illegally dumped waste, holding the original waste producers accountable when possible. If the responsible parties cannot be identified, local authorities must take action to remove such waste and may seek reimbursement for the costs incurred. The text consists of 28 Articles divided into 4 Parts.
