Abstract
The present Ordinance enforces the Directive 2013/30/EU of the European Parliament and of the Council of 12 June 2013 on Safety of offshore oil and gas operations and amending Directive 2004/35/EC. The afore-mentioned Directive requires operators to take all necessary measures to prevent any major accidents and to have available sufficient physical, human and financial resources to limit the consequences when they do occur. It applies to all existing and future installations.
In particular, the present Ordinance provides for the exploration, production and processing of mineral resources in the territorial waters and the continental-shelf of the Federal Republic of Germany (offshore) and related activities and facilities and is applicable as far as it is regulated in this Ordinance to transit pipelines. The Ordinance shall not apply to horizontal drilling from the mainland being situated under a coastal area. Article 2 defines, inter alia, the term offshore oil and gas operations , offshore oil and gas accidents .
Part 1 deals with General provisions as follows: Introduction (1); Measures for the protection of the sea and the seabed (2); Measures for the safety of ship and air traffic and of underwater management infrastructure (3); Aptitude tests; Occupational health and safety (4); Drilling (5); Other duties (6). Part 2 lays down provisions relating to offshore oil and gas operations as follows: Requirements for risk management and the operational plan; Independent review (1); Platform requirements; Emergency measures (2); Other reporting and action obligations (3); Duties of authorities (4). Part 3 concerns final provisions.
