Abstract
This Order sets rules on the management of extractive waste. Waste facilities handling extractive waste dumping into water bodies (inland and marine) shall be subject to pre-approval from national authorities and specific criteria must be met with regard to the classification and the planning management of waste. The purpose of these regulations aims to ensure that accidents are prevented and that the handling of waste is contained in order to exclude or limit damages to the environment. Chemicals and other minerals shall be classified according to the authorized quantity of hazardous substances contained in extractive waste and are listed in the enclosed Appendices. Waste processing facilities shall comply with authorized maximum concentrations of cyanide containing weak acidity when dumping tailings into water bodies as follows: 50 ppm from 7 January 2013, 25 ppm from 1 May 2013, and 10 ppm from 1 May 2018. Safety management procedures shall be applied to prevent accidents when handling waste and strategic planning of these procedures (including plans for closure of such waste facilities) shall be notified to the Environmental Protection Agency.
