Order No. 1393 on permits for the establishment and modification of electricity production facilities and electricity production from onshore facilities.

This Order regulates permits for establishing and substantially modifying electricity production facilities, as well as permits for electricity production from onshore facilities in Denmark. It generally requires prior approval from the Danish Energy Agency for new electricity production plants or significant changes to existing ones, while exempting smaller facilities and certain renewable-energy plants, including solar, wind, wave and hydropower installations, under specified thresholds or notification procedures. The Order sets detailed application requirements for fuel-free plants, fuel-based power and CHP plants, including technical descriptions, grid-connection information, environmental assessments, emissions data, fuel composition, energy efficiency, and, in some cases, cost-benefit analyses on the use of surplus heat and connection to district heating or cooling networks. It also establishes conditions for electricity production from plants over 25 MW, including technical and financial capacity requirements, rules on substantial changes, decommissioning, scrapping and conservation of plants, emission limits for CO₂, CH₄ and N₂O, carbon-capture readiness for large plants, exemptions and possible permit conditions.
