Order No. 1395 on supplementary provisions to the Regulation on the reduction of methane emissions in the energy sector.

This Order lays down supplementary Danish rules for the application of EU Regulation 2024/1787 on reducing methane emissions in the energy sector. It defines “methane actors” as operators, mining companies, undertakings and importers covered by the EU methane regulation, and requires certain information retained under the regulation to be kept in a readable digital format accessible to the Danish Energy Agency. It establishes annual fees and inspection fees payable by methane actors to cover the Agency’s administrative and inspection costs. The Order also provides for confiscation of economic benefits obtained through certain infringements and sets fines for a wide range of breaches, including failures to submit reports, verification statements, repair and monitoring plans, LDAR programmes, leakage records, venting and flaring notifications, and information required from importers.
